Havent you heard BP has had an epiphany and is now a good and straight fellow and will never treat another employer like he has the ones in the past. Thats what a lot of people must think and want BP hired or they dont care whether he has changed or not just as long as he wins football games . Do you people want to have to go through this again in the next 1 to 3 years when this guy looks for greener pastures or lies to his employer(UK) like he has done at previous stops in his illustrious career.
Name one college football team he has left in less than 4 years as head coach? Also have you ever heard of a buy out clause?

So, as a businessman, you have absolutely no problem with a new employee who was recently terminated for cause from his prior employer for exposing them to significant legal liability and lying about it repeatedly to hide it from his superiors who has come to you and demanded a 33% raise from his prior pay scale.
I hope you're keeping your GCL, E&O, and/or D&O insurance carriers informed of your hiring practices.
Can you show me how you're aware there are no pending or settled claims by any parties against Arkansas or Petrino? Or did you just make that "fact" up?

Easy answer. Show me where they are pending? There has been no and I repeat no legal action. Can you refute that. It seems you are getting bent out of shape because things are not going your way. This would make me shy away from hiring you.
Oh and you always neglect the fact that said employee raised profits 59%?

Let me add, this is not an attempt to "pile on" to Mitch. I think Petrino is the best candidate that UK could ever hire, but I'm not sure Mitch or UK should be backed into paying him the obscene ammount his representation is asking for.
What do you mean by pending? As in instituted legal action in the form of a lawsuit? That's not the only way to resolve an issue. There are numerous ways to deal with potential claims or threatened litigation. Some of them even include confidentiality.
You're the one that made the initial claim, specifically that it was a "fact" that neither Petrino or Arkansas were legal trouble. If that is a fact, feel free to show me an executed release by anyone involved in the hiring scandal or even by Ms. Dorrell that will prevent these claims from being made.
You don't get to make up "facts" and then demand people provide proof to refute them without a single shred of proof that your "fact" is anything other than something you've conjured up in your imagination.
I'm certainly not bent out of shape. Concerned, a little, that someone who self-identifies as a "businessman" would make the sort of decisions you would, but not bent out of shape. I seriously doubt that I ever have to worry about my future employment being in your hands.
This is my overarching point as well. I'm not sure (if this were true) how anyone could fault Barnhart for not meeting a clearly ridiculous demand.
Here's your evidence. Miss Dorrell was paid her $32,000 dollars. It's public record. That's fact and public record! You got the number wrong. It was 14,000 for her resignation. She's also bound by confidentiality and cannot discuss the resignation or her time at Arkansas.
Yep, sounds like there was absolutely no legal issue to be dealt with whatsoever.
I'm sure the applicants who were passed over for her hire have never ever considered the improper and illegal hiring practices that kept them from being considered for the position. Heck, we haven't heard anything about it, and that's proof nothing is or has happened, in the business world.

JD the bantering back and forth between you and FBC65 is comical. You arguing that someone fired with cause, sets the employer up for legal issues is ridiculous. Anytime someone is hired or fired the"chance" that litigation may occur from such action is always a possibility. You, being a lawyer, know that. Whether you want BP or not there is always risk in a hire or fire situation. You can only lower the risk with a good lawyer and legal contract, which it seems you are. (you see what I did there)
