    Not sure if you've read more elsewhere (I haven't), but I do not know how you could take that this situation is worse from this article. There were hardly any details.

    I believe that the Burress incident was simply having a firearm in his possession and shooting himself in the leg. He didn't assault anyone. Charges for criminal possession for a firearm I would assume are much less onerous than for aggravated assault with a firearm. However we are talking about NYC versus Miamuh, so it may be okay to wave a gun in someone's face in Florida.

  • Assault just means you put someone in fear of a battery... i.e. he showed the gun to scare someone that he was going to shoot them. It is aggravated because of the presence of a firearm. The title sounds a lot worse than it actually is. I don't mean to insinuate that its not serious crime/tort or to suggest he won't face any punishment, but typically speaking it is not severe. That being said, the punishment handed down by Goodell will likely be the big consequence for Dumervil. Being a Saints fan, I would expect it to be fairly harsh.

    This sounds pretty serious to me.

    As I said, I'm not condoning the behavior or suggesting he doesn't deserve punishment. It is serious... but in the context of criminal liability, an assault is not that major because there was no damage except to the emotional state of the person who was assaulted. I don't mean to suggest he won't be punished... but if you think he will be going to jail I think you will be disappointed.

  • I'm not an attorney. I have no idea what will happen to him. But I, as a lay person, feel that flashing a gun at a traffic light at the very minimum needs revocation of a concealed carry license and a significant probation. You sound more educated on the matter than I, so I'll assume that you are correct.

  • It is a serious matter and is not to be taken lightly. I agree that Goodell will come down on him hard, but in the grand scheme of things, a gun going off is more serious than a gun not going off.

Which, in my opinion, in a criminal context is not that bad... that's why I think the punishment he gets from Goodell will be far more severe. And rightfully so, that conduct would get you fired from a lot of companies.

  • Mrbaseball is right on with his comments. He will probably plead down to a lesser charge and get probation. I also look for goodell to suspend him a minimum of four games and won't be surprised If its 8.

    and the fact that it was illegal in the first place to possess a handgun in NYC if I believe correctly. So not only was what he did illegal, but he shot himself too. Double whammy. But haven't read much on this, but not very smart
